Draft Minutes of the Meeting of Lockton Parish Council held on Monday March 20th 2017 at 7.30pm in Lockton Village Hall

Present: Cllrs. David Stewart, Jennifer Halmshaw, Liz Stead, Jenny Bentley & Mark Bentley. Also Cllr Janet Sanderson, Stuart Warriner, Jason Winspear, Angela Carter & Sandra Culley. Clerk Jackie Edenbrow.

1703/01 Apologies

1703/02 Declaration of interests

1703/04 Matters arising/ ongoing

/01 Stones on verge edge
Since the last meeting, David Foster has complained that large vehicles are now driving over the verge since he removed the stones. This was reported to Cllr Janet Sanderson when she visited the village. She reported that it was not possible to curb the verge due to cost. Wooden bollards would just get damaged by large vehicles. NYCC Highways will monitor the area.
/02 Track opposite cemetery
Cllr Janet Sanderson viewed this area when she visited the village. The ownership of the land is unknown though the Parish Council has maintained the trees and cut the grass. The ownership needs confirming before any work can be done clearing the area.
/03 Driveway across village green
The Clerk has not yet heard from NYMNP about a planning application. Jennifer has seen Adrian Bury to discuss the problems with parking in this part of the village.
/04 Ownership of land eg verges
Some of the land within the Parish is not registered with the Land Registry but is regarded as Parish land as it has been maintained by the Parish Council. The Clerk will make some initial enquiries into ownership of land. Cllr Janet Sanderson enquired about the Parish Plan. This was prepared in 2003/4. Janet suggested that this should be updated and include issues such as this. The Clerk will contact Maggie Farey to discuss what options & grants are available to carry out an update of the Parish Plan.
/05 Moles
Moles have been removed from both the cemetery and the verge outside Box Tree Barn. Jenny was asked to thank the mole catcher.
/06 Land down Overscar Lane
The Clerk has received an email from Amanda Thorpe stating that she is interested in renting the fenced area with Angela Carter. Angela confirmed this and gave some details of the work they hoped to complete. Angela also would like to rent the triangle of land adjacent to the driveway which has been neglected. The Clerk will make out new agreements which reflect the current situation for both areas & these will be checked with Ami Walker at NYMNP to ensure that the necessary safeguards are in place for the management of the areas. An annual rental will also be agreed with Amanda & Angela.
/07 Cricket field
The Cricket Club would like to continue the rental of the cricket field in the hope that a team can be raised next year. They will continue to cut the grass. Other uses for this area have been suggested such as a wildlife area & allotments but this will be put on hold for now. Concerns were raised about trees which have been planted in the cricket field. No one has contacted the Parish Council or the cricket club to ask permission. Two of the trees would obscure the view at the junction if allowed to grow. As the cricket club is continuing to maintain the area, the Clerk will notify Steve Stead their Chairman about the concerns regarding these trees.
/08 Tour de Yorkshire
One meeting has taken place & several suggestions were put forward for decorating the lane end. There will be a follow up meeting on April 3rd when final decisions can be made. Mark was thanked for organising this.
/09 Youth Hostel
The Clerk had not written to the YHA as some improvements had been made to the outside appearance of the Youth Hostel but Jenny Bentley had done this. Some of the church wall near the Youth Hostel has fallen down & concerns had been raised that this had been caused by YHA visitors. However it was confirmed that this wasn’t the case. The Clerk will write to the Youth Hostel about the current concerns. The Clerk will contact Davd Cockerill to ask him to repair the wall.

1703/05 Correspondence
/01 NYMNP – Southern Area Parish Forum – minutes & poster
The poster will be put on the village noticeboard. An item at the last meeting concerned Parish caretakers. The role of the Parish caretaker was discussed. The Clerk will find out more details about the grant scheme that NYMNP operate which can cover 50% of the costs. A caretaker could carry out some of the maintenance work maintaining areas such as opposite the cemetery. This could be an item on the Parish Plan update.
/02 RDC – NYCC Council election poster
Already on the village noticeboard.
/03 NYCC – Pothole reported
The Clerk had reported the poor state of Hudgin Lane. This has been inspected by NYCC Highways but does not meet the criteria for repair.
/04 NY Police – Stats for Feb
Details noted.
/05 Fields in Trust – preservation of green spaces
Areas such playing fields are unlikely to be sold off for development as Lockton is in the National Park. This item could be included in the update of the Parish Plan.
/06 Frack Free Ryedale – PEDL licence 120 – INEOS
Details noted.
/07 Yorkshire Derwent Partnership – news update
Items of interest include the news that NYMNP have received a grant of £275,000 from the Heritage Lottery fund to revitalise the River Rye’s heritage. Also there is an item on invasive species such as Japanese knotweed. The group are wanting details of where invasive species are located. The Clerk will email with details of the problems at the Howl.
/08 Thornton Dale Ward Parishes meeting – agenda
The Clerk is attending this meeting which will include an item on ownership of land.
/09 HMRC – PAYE
The new tax code sent for 2017/8 for the Clerk is incorrect.

Stones on verge edge, track opposite cemetery & driveway across village green
The stones on the verge have now gone so NYCC Highways must have sent a letter to David Foster. The state of the track opposite the cemetery was discussed & it was agreed that this should be returned to a grassy track. The Clerk will email Highways. The Clerk has heard nothing about the driveway either from Planning or Adrian Bury so the Clerk will email Planning to find out progress.

Ownership of land eg verges
The problem of who owns what land keeps cropping up in connection with verges and tracks. The Clerk will discuss this with NYCC Highways & has asked for this to be put on the agenda for the next Thornton Ward meeting. Cllr Janet Sanderson has said that this is a problem that many Councils face.

These were removed in December. The wood & chippings are still available.

Land down Overscar Lane
Jennifer & Ray Halmshaw, the Clerk, NYMNP Ami Walker, Betty Hughes & Angela Carter met in January to look at the area down Overscar Lane. The septic tank for the bungalow is in this area & the occupants of the bungalow are responsible for the fencing down one side of the area. The area has been somewhat neglected since NYMNP did some work in 2009. Ami left a basic management plan which had been drawn up by NYMNP at that time. The area also includes the driveway to the two properties and a small triangle of land to the right of the driveway. Both Amanda Thorpe & Angela Carter have expressed an interest in the land. The Clerk will write to Angela to confirm their right of access over the driveway & to request that the Parish Council is informed before any improvements are made to the track. The Clerk will write to both Amanda & Angela asking for them to give written confirmation of what land they would like to rent & what their management plan would be for the area to be received before the next Parish Council meeting.

Cricket field
The cricket club has now folded so a new use for this area is required. The possibility of this being used for grazing or another wild flower area were mentioned. A note will be put in the next Cryer & on the noticeboard asking for any suggestions for its use.

This project has received additional funding to continue its work.

RDC - Tour de Yorkshire grant
The route on day one passes Lockton Road end. RDC has offered a grant of £100 to decorate the road end on that day. The Clerk applied for the grant & this has been received. It was decided to have a village meeting to discuss how to decorate the area. Mark offered to organise this meeting which was arranged for Monday March 3rd at 7.30pm. Mark agreed to prepare a flyer which the Clerk will print & distribute round the village.

NYCC – Urban grass cutting payments 2017/8
Notification has been received regarding payment for grass cutting for 2017/8. This will be £123.17. The Clerk emailed the response form confirming that the Parish Council wished to continue the grass cutting.

A complaint has been received concerning the appearance of the Youth Hostel. Since the change in manager, the outside of the Youth Hostel has not been cleaned with piles of leaves & bird droppings. The Clerk will email to complain.

/01 NYCC response to queries on stones on verge edge, hardcoring track opposite cemetery & driveway across village green
A response had been received from NYCC Highways & circulated by email to all the Councillors for comment. As a result the Clerk had emailed NYCC Highways to ask them to write to David Foster to ask him to remove the stones. Highways confirmed that the Parish Council have no obligation to contribute to hardcoring a track. They also said that permission was needed if it was a new track & the Clerk had told them the location as requested. The Clerk had also sent details of the driveway outside Brecklands for them to check if this area was within their control. There was concerns raised regarding the questioning of Gretchen at the last meeting. The Councillors asked Geoff to pass on the Council’s apologies to Gretchen if she thought the questioning was harsh but that the Councillors were just trying to ensure all the facts were covered. Colin asked for the minutes of this item from the last meeting to be read. He disagreed with the minutes & stated that he was still not happy about the way his complaint about the Clerk had been handled. As a result, he left letters for each Councillor & the Clerk and said that he would be taking the matter further.
Colin left the meeting.
/02 Trees in cemetery
David Bayes has arranged to come on Wednesday December 21st to fell the dangerous conifer in the cemetery. It was suggested that the Clerk put a note in the next Cryer asking if anyone would like to purchase some or all of the wood. The Council would consider giving a donation to help the play area maintenance if funds were raised.
/03 Moles
Three moles have been caught in the cemetery & one outside Box Tree Barn. Jenny said that the mole-catcher did not want paying. Jenny was asked to thank him.

1611/05 Correspondence
/01 RDC – Precept for Financial Year 2017/8
The Clerk had prepared a summary of the estimated financial position at the year end and a projection of income & expenses for 2017/8. The cemetery fees and the three rentals were also discussed. It was decided that the cemetery fees & the rent fees should remain the same for the coming year. To ensure that the Council had the reserves to cover any unexpected costs, the Councillors agreed to increase the precept for 2017/8 to £3500.00. The precept form was completed by David & the Clerk & will be sent to RDC before their cut-off date.
/02 RDC – Rough Sleeper Estimate 2016
There were no rough sleepers in Lockton on November 14th as far as the Council was aware.
/03 NYCC – grass cutting remittance advice
The remittance of £105.57 has now been received for this year’s grass cutting.
/04 NYCC – Ryedale Area Committee meeting – notice & agenda

/06 YLCA - adoption of telephone boxes - request for information
As BT are now wanting to close & remove many phone boxes, YLCA are gathering information from Councils who have already adopted them. The Clerk will email details of our experience.
/07 Citizens Advice Ryedale – Annual Report & request for donation
This organisation is offering a much needed service which includes an access point in Pickering. It was decided that the Council would give a donation this year of £100.00. This will be made at the next meeting.

/09 Beeline Broadband Ltd – fast reliable broadband in Ryedale
This company offers broadband to areas with very slow broadband. Lockton has a reasonable broadband so there was no interest. Mark asked for a copy of this to be emailed to him.
/10 Russell Scott – freedom of information request about fracking
This is a request for information on our correspondence with fracking companies. There has been no correspondence & the Clerk will email to state this. David asked about the Council’s freedom of information policy which was prepared several years ago. The Clerk will find the policy details & email to Councillors.

/01 Review of annual ground rents
This was mostly covered in item 1611/05/01. As Betty Hughes will probably now be moving in January, the Clerk will find the current rental conditions for the land down Overscar Lane. Also the Clerk will contact NYMNP again to ask their advice about the conditions.
/02 Removal of hedge between fields recently sold
A resident has raised concerns about the removal of this hedge. As NYMNP are now aware of the situation there is no further action required.

1610/04 Matters arising/ ongoing
/01 Defibrillator & training
The defibrillator & CPR training has been arranged for Thursday November 3rd at 7pm in the village hall. The Clerk will prepare some flyers which she & Julie Witte will deliver. Julie had been concerned that some infant pads were required for the defibrillator but the adult ones are also suitable for children. Phill Witte has replaced the bulbs in the phone box & sent the invoice recently. The defibrillator fund still has a deficit of £42.39. It was decided that the Parish Council would write this amount off. The Councillors requested that the Clerk email both Julie & Janilaine to thank them for all their work & fundraising for this project.
/02 Tarmac opposite cemetery
This has now been broken up & removed as requested & crushed tarmac/hardcore has been laid by NYCC Highways. Gretchen raised concerns about the surface laid as it might be unsuitable for horses & for tractors taking sillage to her fields. She requested that the tarmac was replaced or hardcore laid. Clive Welburn used to use the alternative, longer track to reach the fields but since he left, this shorter track has been made. It was confirmed that Gretchen would be able to use the original track to get her horses from the field. It was decided to request some guidance from NYCC Highways on what obligations the Parish Council had on tracks over verges. The Clerk will email NYCC. Colin said that he was concerned about the Clerk’s conduct on this matter & requested details on the results of his complaint. David stated that this was an employment matter & not for discussion at this meeting. Colin disagreed but David requested that Colin write to him with all his concerns.
Colin & Gretchen left the meeting.
/03 Trees in cemetery
David Bayes has been unable to do the work as his shredder has been out of action awaiting repair. The Clerk will email him to find out when he can do the work.
/04 Old garden equipment
The only offer made for the broken lawn tractor was from Jason Winspear who has offered £80. As this was the only offer, it was agreed to accept this. The Clerk will arrange this with Jason.
/05 North York Moors local plan questionnaires
These were discussed but it was decided not to complete them.
/06 Playground inspection report
The report highlights several problems. This will be passed to the Playing Field Committee with a request that work is carried out in the spring.
/07 Moles
Jenny has arranged for work to be carried out on trapping the moles. Three have been caught in the cemetery & now the problem on the verge by Box Tree Barns will be tackled.

/01 Bench looking towards WarrenFarm
The Hunt would like to put a bench in memory of Bryan Brown on the verge overlooking Warren Farm. They will prepare a base for it. This was approved.
/02 Trees in the Howl near Box Tree Barn
These are starting to grow up alongside Box Tree Barn. It was agreed that these should be cut down before they become a more serious problem.
/03 Driveway across village grass
A complaint from a resident has been received about the paving slabs placed alongside the concrete strips outside Brecklands. An email of support has also been received from another resident. These slabs were considered to be out of keeping. The Clerk was asked to request guidance from NYCC Highways on this matter.
/04 Financial position at half year
A breakdown on the current financial position of the Council with projected income & expenditure for the rest of the year was discussed. Expenditure for this year is predicted to be the same as income.
/05 Stones on verge by Levisham turnoff
These have now been replaced by David Foster after vehicles drove over the verge recently. The Clerk was asked to request guidance from NYCC Highways on this issue.
/06 Parish Council land on Overscar Lane
Amanda Thorpe has emailed to say that she is still interested in renting this area. Betty Hughes has probably sold her house so the future of this area will need to be discussed in the coming months. The Clerk will email Amanda to thank her for her continued interest.
/07 NYCC Grass Cutting Payment
As no information had been sent from NYCC Highways regarding requesting payment for this year, the Clerk had contacted them. There has been a delay this year but now the Clerk has received the required information & has requested payment of £105.57.

Defibrillator
There is no news on the training. Julie Witte is still trying to arrange this.
/02 Tarmac opposite cemetery
Janet Sanderson has not had a reply yet to her query concerning this long outstanding issue. There is a new manager at Highways Kirby Misperton and she is meeting him in a couple of weeks to sort out several items including this one.
/03 Potholes
Alan Sawdon has not contacted the Clerk yet. However when Highways came to repair the potholes in the Square & near Coronation Farm they had some spare tarmac which they used to fill in most of the potholes. It was decided that there was no need for further repairs at the moment.
/04 Standing orders
These were agreed and unanimously adopted by the Councillors.
/05 Audit
This has now been completed by the external auditor. There were no concerns raised. The Clerk will put a copy in the village noticeboard & put a note in the next Cryer. The Clerk will also arrange for this to be set up on the heritage website.
/06 Trees in cemetery
The Clerk has notified Mark Antcliff at NYMNP about the work. David Bayes has not yet given a date for the work.
/07 Old garden equipment
Ongoing.
/08 Declaration of compliance regarding pensions
The Clerk has completed the declaration online. A letter has been received confirming that this has been done.
/09 Grass cutting 2017
The quote for grass cutting for 2017 & 2018 has been received from Steve Hough. The price has increased as the current price has not been financially viable. It was decided to accept the quote for the two years. There have been several comments about how well the work has been done this year. The Clerk will email Steve. Jenny commented on the large molehills on the green by Box Tree Barn & the Clerk had noticed some in the cemetery. It was agreed that these should be sorted out. Jenny said she would give the Clerk the name of the ‘mole man’.

Jenny declared an interest as she is a trustee. The play area has recently been inspected. The Clerk has received an email stating that the aerial runway is faulty & should not be used. Mark said he would look at this & ensure that it could not be used. When the full report is received this will be passed to the Play Area Committee.

/01 Defibrillator
Julie Witte has not been able to arrange for the training yet. She has received another £60 in donations which she has given to the Clerk. She has reported that someone had opened the cabinet but no damage was done to the defibrillator.
/02 Tarmac opposite cemetery
Janet Sanderson emailed the Clerk regarding whether this was still outstanding. The Clerk replied that David was going to send a letter to her concerning this. She replied that she would follow this up with Highways without the need for a letter.
/03 Potholes
The Clerk had contacted Alan Sawdon & he will ring the Clerk when he can come to look at the potholes in order to quote for the repairs.
/04 Standing orders
These will be adopted when all the Councillors are present.
/05 Audit
The Clerk had been contacted by the external auditor requesting more information. The Clerk sent this by email & the auditor confirmed that this information was correct.
/06 Trees in cemetery
The Clerk has looked at the conifer causing concern again & it is not definitely not as healthy as the similar conifer. It was decided that the tree should be removed to avoid any damage. Andrew Brown has offered to carry out this work. However due to the position of the tree near gravestones & the wall, it was decided that David Bayes should do the work as he is insured. Jenny was asked to thank Andrew for his offer of help. The Clerk will contact David Bayes to arrange this work & also notify Mark Antcliff at NYMNP that this work needs doing.
/07 Old garden equipment
There has been no progress with this yet. The Clerk will put up a notice to see if there is any interest in purchasing the lawn tractor.
/08 Declaration of compliance regarding pensions
The Clerk has inputted the required data. This was checked by David. This will now be submitted before the compliance deadline.

No one was able to attend this meeting.

The deadline for completing this survey is the end of this week.

Westfield Lane & Crossdale have now been surface dressed. The correspondence from some Parishes
was complaining about signs being set up notifying of work but then no work took place.

Jennifer had previously suggested that residents should be reminded about the Cryer so this will be included in the note.

Defibrillator
The defibrillator has now been installed in the telephone box. The electrician did the work free of charge. Julie has had to buy some new signs as the previous ones did not fit the phone box. Julie would also like to arrange the training course. She has suggested a Thursday as a suitable day. It was agreed to delay any training until after the school holidays. All Thursdays in September are free in the village hall. The Clerk will email Julie to thank her for all her hard work in organising the defibrillator installation & to suggest the training days. The Clerk will also email Mike & Carolynn Nowill to thank them for renovating & painting the phone box.
/02 Street light by Hope House
NYCC connected the street light the day after the previous meeting & this is now working.
/03 Tarmac opposite cemetery
The Clerk has still to draft the letter to Janet Sanderson.
/04 Potholes
The potholes in the road in the Square have been reported to Highways & the inspector has been & painted round them in yellow so they will be repaired at some stage. The Clerk has tried to contact Alan Sawdon but has been unable to as yet.
/05 Standing orders
It was decided that these should be adopted when all the Councillors are present.
/06 Stones on verge edge
These have now all been removed including the ones on the corner of the triangle.
/07 Audit
This has now been sent to the external auditor. The form regarding residents viewing the accounts has been put in the village noticeboard.

1607/08 New Business
/01 Trees in cemetery
The right hand cypress tree at the Methodist end of the cemetery has some branches which are leaning. The Clerk asked David Bayes to look at it when he was doing some work at the village hall. He says that the base has split & the branches will gradually lean more. He wanted a second opinion & the Clerk has asked Mark Antcliff from NYMNP to have a look at it. David thinks it has a life expectancy of 5 to 10 years. It could have the worst of the branches removed but that would leave the tree looking unsightly & would not be economical as it would need to be removed in the future. It would take a three man team a day to remove. This will be discussed again after Mark Antcliff has given his opinion.
/02 Tree on PC land down Mill Bank Lane
The owner of Sunny Crest has spoken to the Clerk & stated that the tree by the cliff face is definitely dead. He & Geoff Brown are prepared to remove the tree if the Parish Council agrees. The Clerk will email to confirm that the tree can be removed.
Jennifer Halmshaw arrived & offered her apologies for being late.
/03 Old computer/garden equipment
The Clerk has two old printers & a scanner which do not work & are not compatible with Windows 10. It was agreed that these could be disposed of & the asset register updated. The ride on mower is also no longer used. David will make some enquiries to see if there was any interest in purchasing the mower.
/04 Gravestone at cemetery
A gravestone has fallen over and broken in two pieces. The Clerk arranged for one part to be moved as this was causing a hazard on the footpath but the larger part was very heavy. The grass cutters were able to move this when they were next at the cemetery. The Clerk had emailed to thank them.
/05 Residents only parking sign
The ‘residents only’ sign on the ‘no through road’ post has broken. The Clerk gave a new sign to Jennifer to install.

1605/04 Matters arising/ ongoing
/01 Defibrillator
The paint has now arrived & has recently been given to Mike Nowill. When the painting is complete Julie will arrange for the electrician to install the defibrillator box. The training will take place after the defibrillator has been installed. The accounts for the defibrillator fund were discussed. There is still a deficit of £102.39 but fund raising is still continuing. The financial position will be reviewed in October.
/02 Street light by Hope House
Paul Gilmore from NYCC had arranged for Northern Powergrid to connect the street light to the electricity supply. This work was carried out but the street light still doesn’t work. The Clerk has now emailed Paul again regarding this but has not had a reply yet.
/03 Tarmac opposite cemetery
The Clerk has emailed NYCC Highways requesting a response regarding this problem but has still not had a reply. It was decided to send a letter from the Chairman to Cllr Janet Sanderson, copied to NYCC Highways Richard Marr, requesting that the tarmac should be removed. The Clerk will send a draft to David for his approval.
/04 Potholes
The Clerk will report the potholes in the Square & outside Coronation Farm. The Clerk will also contact Alan Sawdon about a quote for the tarmac.
/05 Standing orders
The Clerk has emailed the final part to David. It was decided that the Clerk should email the complete proposed standing orders to all Councillors and these would be approved at the next meeting.
/06 Audit 2016 – annual governance statement
The annual governance statement on the annual audit form was completed and signed by the Chairman & Clerk.
/07 Audit 2016 – accounting statements
The accounting statement on the annual audit form was completed and signed by the Chairman & Clerk. Now that the accounts have been approved by the internal auditor, the Clerk will send all the required information to the external auditors.
/08 Insurance – quotes from Aon & Zurich
The renewal quote from Aon was for £346.72. The Clerk had asked for a quote from Zurich. The first quote was for £276.81. However, as we are a small Parish Council we were eligible for their small Council policy. The quote for this was £201.42. The details given for this quote were assessed & it was decided to accept the lower Zurich quote. The Clerk will email to accept the quote & will send the cheque after receiving the invoice.
/09 Stones on verge edge
A letter has been sent to David Foster recently regarding the removal of the stones. It was decided that if the stones were not removed as requested within the next couple of weeks, the Parish Council would have to remove them and leave them adjacent to his property.
